Note: Samuel Mays, friend of Thomas Anderson, executor of William Anderson’s will (see below), writes this codicil to his own probate:

Mays’s friend Thomas Anderson has been unsuccessful in some of the undertakings in consequence of which three tracts of land belonging to said Anderson have been sold by the sheriff, and Mays bought them at what he considers a low price; and in consequence of a friendship with old Capt. William Anderson in his lifetime, Mays feels duty bound to assist Anderson’s family rather than take advantage of them and advance his own. He hereby gives in trust to Thomas Anderson and Dr. James Spann for the children of Thomas Anderson namely Lein?, Eliza Ann, John and Thomas M. all the plantation lying on both sides of Wilson Cr. containing 942 acres and a mortgage given to Mays as executor of William Mays (location of acres described, including mill tract as it is called). “It is my express will that the said mills and land shall immediately begin by my executors to the said Thomas Anderson and Dr. James Spann in trust and as trustees for the children of Thomas Anderson and Dr. James Spann until the youngest child become at the age of twenty one years and then to be equally divided among my children. I also authorize the said trustees (in case they think best) to sell up to one half of the land and use the proceeds as the profits are used.”

First, I give and Bequeath my soul to God that gave it to me and my Body at the Discretion of My Executor, to be Buried in a Christian Like manner & my worldly Estate [I give in] Manner and form

I, Robert Anderson, being of sound disposing mind memory and understanding, Do make this my Last Will and Testament in manner and form following:

Immediately at my death my will and desire is that all my personal property go into the actual occupancy and possession of my wife*

I give and bequeath to my dearly loved Wife two negroes, namely CATE and FILLIDA to her and her Heirs forever

I give and bequeath to my Daughter Betsey when she shall marry or come of age negro Tony, bed, and Furniture, Cow and calf Sow and pigs and thirty Dollars in money to her and her Heirs forever

I give and bequeath to my daughter Sally when she shall come of age or marry, negro named ROSE, Bed and Furniture Cow and calf Sow and Pigs and thirty Dollars in money to her and her heirs forever
